Article 1/ General provisions
The present General Sales Conditions (GSC) govern the sales of pipes and accessories, made through the website pipe-tristan.com, and are an integral part of the Contract between the buyer and the seller. They are fully opposable to the buyer who has accepted them before placing an order.
Tristan Lefebvre reserves the right to modify these terms and conditions at any time by publishing a new version. The GCS applicable at that time are those in force on the date of payment of the order.
Tristan Lefebvre also ensures that their acceptance is clear and unreserved by placing a checkbox before the order is validated. The customer declares that he/she has read all the present General Terms and Conditions of Sale and accepts them without restriction or reservation.
Article 2/ The Customer
This site is freely accessible to all individuals aged 18 and over, who have the legal capacity or parental authorization to place an order on the site.
Article 3/Products
The purpose of the Pipe-Tristan website is the online sale of pipes and accessories. The descriptions and essential characteristics of the products and their respective prices are made available to the buyer on the Pipe-tristan.com website. In accordance with article L112-1 of the French Consumer Code, the consumer is informed of the prices and specific conditions of sale before concluding the sales contract. In all cases, the total amount due by the buyer is indicated on the order confirmation page. The sale price of the product is that in force on the day the order is placed, and does not include shipping costs, which are invoiced in addition. These costs are indicated to the buyer during the sales process, and in any case at the time of order confirmation. The seller reserves the right to modify its prices at any time, while guaranteeing the application of the price indicated at the time of the order.
Article 4/ Ordering
The order-taking procedure involves a succession of different stages that the customer must follow to validate his order (choice of products, choice of delivery address, choice of payment method and validation). Before finally validating the order, the customer will be able to check the details of the order and its total price on an order summary. They may modify their order if they wish.
Product offers are subject to availability. Information on product availability is provided for information purposes only at the time of ordering. However, if, exceptionally, the product becomes unavailable after validation of the order, the customer will be informed by e-mail.
Tristan Lefebvre reserves the right to cancel or refuse an order from a customer who has had a dispute with a previous order. In this case, Tristan Lefebvre will inform the customer by e-mail.
A confirmation email summarizing the details of the order will be sent to the customer. Consequently, the customer accepts de facto the sole use of e-mail for order confirmation.
Article 5/ Prices and terms of payment
5.1/ Pricing
The prices of each product are net, excluding tax (VAT not applicable art 293B of the CGI), in euros (or dollars), excluding shipping costs. They may be revised at any time without notice.
Items are invoiced in euros on the basis of the prices indicated on the site at the time of ordering. The total price of the order (products + shipping costs) is indicated in the basket.
The customer acknowledges that he/she is considered the official importer and that, depending on the country, he/she may have to pay any customs duties which are the responsibility of the recipient. These duties are not the responsibility of Tristan Lefebvre.
5.2/ Payment terms
The price is payable in cash, in full, on the day the order is placed by the customer, by secure payment, using the following methods: bank transfer, cheque or Paypal account.
5.3/ The data recorded and kept by Tristan Lefebvre constitutes proof of the order and of all past transactions. The data recorded by the payment system constitutes proof of financial transactions.
Article 6/ Delivery
Products are delivered to the delivery address indicated when the order was placed.
Orders are dispatched within two working days of receipt of payment. Orders placed between Friday and Sunday evening will be processed the following Monday.
Shipments within France are by Colissimo with delivery against signature. Delivery will be made in 48h or 72h (these times are purely informative and are not guaranteed).
All shipments outside France are made by "international package" with tracking.
Once your order has been handed over to the carrier, Tristan Lefebvre cannot be held responsible for delivery delays, which may be long or irregular, or for any deterioration of products during transport.
Exceeding delivery times may not give rise to deductions, damages or cancellation of an order in progress.
If your order has not been delivered within 30 days of dispatch, and the parcel has been lost, we will offer you a refund. This can only be done after an investigation has been opened with the carrier, who will confirm whether or not the package has been lost. It may take up to 60 days to trace the package.
In the event of damaged packages, the customer undertakes to notify the carrier and Tristan Lefebvre, via the contact form, of any reservations within 3 days of receipt of the package.
Article 7/ Withdrawal period
In accordance with the provisions of article L 221-5 of the French Consumer Code, the individual Buyer has the right to withdraw from the contract without giving any reason, within fourteen (14) days of receipt of the order.
The right of withdrawal can be exercised by contacting the auto-entrepreneur by e-mail at this address: .
If the right of withdrawal is exercised within the aforementioned period, the customer will return the unused products in the condition in which they were received, and will be reimbursed for the price of the product(s) purchased and the cost of shipping, with the cost of return remaining at the customer's expense.
Article 8/ Refunds
Refunds for products returned after retraction will be made by Tristan Lefebvre within a maximum of 30 days after receipt of the returned products. This will be done by the method of payment chosen by the customer or by vouchers.
Article 9/ Intellectual property
The content of the www.pipe-tristan.com website is protected by French and international intellectual property laws.
Any reproduction of this content, in whole or in part, is strictly prohibited and may constitute an infringement of copyright.
Article 10/ Applicable law
Any question relating to the present General Conditions of Sale as well as to the sales which they govern, which would not be treated by the present contractual stipulations, will be governed by French law to the exclusion of any other law. In the event of a dispute, the French courts will have exclusive jurisdiction.
Article 11/ Data processing and liberties
In application of the law 78-17 of January 6, 1978, it is recalled that the personal data which are requested from the Customer are necessary for the treatment of its order and the establishment of the invoices, in particular. The Customer has, in accordance with the national and European regulations in force, a permanent right of access, modification, rectification and opposition with regard to the information concerning him.
Article 12 /Personal data protection
In accordance with Regulation 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, the Seller implements the processing of personal data, the purpose of which is the sale and delivery of products and services defined in this contract.
